1. Introduction

Welcome to Make It Write ("the Service," "we," "us," or "our"), an AI-powered writing platform operated by Differson LLC. These Terms of Service ("Terms") govern your access to and use of the Make It Write web application and all related services.

By creating an account, accessing, or using Make It Write, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

Important: These Terms include provisions that limit our liability, require arbitration of disputes, and contain an AI-generated content disclaimer. Please read them carefully.

2. Account Registration & Eligibility

Age Requirement

You must be at least 13 years of age to create an account and use Make It Write. If you are between 13 and 18 years old, you may only use the Service with the consent and supervision of a parent or legal guardian.

Account Security

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

3. Subscription Plans & Payments

Available Plans

  • Free Plan: Limited to 10 chat messages, library browsing only
  • Premium Plan ($9.99/month): Unlimited chat messages, full post creation and publishing capabilities, earning potential from likes

Payment Processing

All payments are processed through Stripe. Subscriptions automatically renew unless canceled before the renewal date.

Refund Policy

All subscription payments are generally non-refundable. By subscribing, you acknowledge and agree to the following:

  • Suspended or Terminated Accounts: If your account is suspended or terminated due to a violation of these Terms, you are not eligible for any refund of fees paid.
  • Feature & Service Updates: Make It Write may update, modify, add, or remove features at any time as part of ongoing platform development. Such changes do not constitute grounds for a refund.
  • 7-Day No-Use Refund Window: If you have subscribed but have not used the service at all (no posts generated, no chat sessions initiated), you may request a full refund within 7 days of your initial purchase by contacting us at contact@differson.net. Refund requests made after 7 days or with any recorded usage will not be honored.

Outside of the conditions above, refunds will only be considered in cases of complete service unavailability lasting more than 30 consecutive days caused by Make It Write.

4. User-Generated Content & Earnings

Copyright Ownership

  • Users own the copyright to their creative input (prompts, ideas, conceptual direction)
  • Users receive a commercial license to AI-generated content while maintaining an active Premium subscription

Revenue & Earnings

  • Like-based Earnings: $0.003 USD per like on published posts
  • Payout Method: Stripe Connect (direct to bank/card)
  • Eligibility: Must have active Premium subscription and connected Stripe account to receive payouts

5. AI-Generated Content Disclaimer

While Make It Write employs advanced AI technology (GPT-4o, DALL-E 3, TTS) to generate unique content, there is always a possibility that AI-generated content may inadvertently resemble existing copyrighted works. Users acknowledge and agree that:

  • Make It Write makes no guarantee that AI-generated content is entirely free from similarities to existing works
  • Users are responsible for conducting their own due diligence before commercial use
  • Users agree to indemnify Make It Write against any third-party claims arising from their use of AI-generated content

6. User Rights & Responsibilities

Prohibited Content & Conduct

You agree not to post, publish, share, or distribute any content that:

  • Is knowingly false, misleading, or constitutes misinformation or disinformation
  • Is defamatory, harassing, abusive, threatening, or hateful toward any individual or group
  • Infringes upon the intellectual property rights, privacy, or publicity rights of others
  • Promotes or facilitates illegal activities, violence, or self-harm
  • Contains spam, unsolicited advertising, or manipulative engagement tactics
  • Impersonates any person, entity, or brand in a deceptive manner
  • Violates any applicable local, national, or international law or regulation

Content Removal

Make It Write reserves the right, at its sole discretion, to review, moderate, remove, or restrict access to any content that violates these Terms or is otherwise deemed harmful, unethical, or inappropriate — without prior notice or explanation to the user. This includes but is not limited to content containing false information, hate speech, or content that endangers the safety or well-being of others.

Account Suspension & Termination

We reserve the right to suspend or permanently terminate accounts that repeatedly violate these Terms, engage in abusive conduct toward other users, or attempt to manipulate or exploit the platform. Suspended or terminated accounts are not eligible for any refund of subscription fees paid, regardless of the remaining subscription period.

7. Privacy & Data Protection

Make It Write is committed to protecting your privacy and personal data. Our data collection, storage, and usage practices are detailed in our Privacy Policy.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIFFERSON LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE EVENT, OR $100, WHICHEVER IS GREATER.
